Abu Dhabi: Abu Dhabi has enacted a new personal law for non-Muslims. Non-Islamic marriage, divorce, child custody and inheritance rights will be governed by the new law. H.H Sheikh Khalifa bin Zayed Al Nahyan, President of the United Arab Emirates and Ruler of Abu Dhabi, issued the new ordinance on personal law.
The new Personal Act contains 20 new sections covering marriage, divorce, joint custody of children and inheritance. The first chapter of the law deals with the marriage of a foreign man and woman. The second part of the law deals with the divorce proceedings of non-Muslims and the rights of men and women after divorce. This second chapter also describes the judge\’s discretion in assessing financial rights based on a number of criteria, including the length of time they have been married, their wife\’s age, and financial status.
Chapter 3 deals with the protection of children after divorce and Part 4 deals with inheritance. A special court will be set up in Abu Dhabi to hear family cases of non-Muslims. Proceedings in this Court will be conducted in English and Arabic.
